An Ohio man who was shot by the father of an 11-year-old girl he is accused of raping has been indicted for multiple felony counts.
Diego Montoya Gonzalez, 20, was indicted on five counts of pandering sexually oriented material involving a minor, two counts of rape and one count of obstructing official business, according to court records.
He pleaded not guilty at his arraignment in Franklin County Common Pleas Court, WBNS reported.
The case came to light on July 15 after the girl’s mother reached out to authorities when she discovered a video on her daughter’s phone that seemed to indicate sexual conduct, the outlet reported, citing prosecutors.
The following day, the girl’s father allegedly lured Montoya Gonzalez to their home by pretending to be his daughter on TikTok, prosecutors said, per the outlet.
According to the outlet, citing a criminal complaint, the girl’s father claimed he planned to beat up Montoya Gonzalez and then notify police, but believed he saw the 20-year-old reaching for a weapon, which prompted him to open fire. Montoya Gonzalez was allegedly shot twice in the ordeal, per WBNS.
A neighbor told WSYX that she couldn’t believe it.
“I can see why he went after him, she said, per the outlet. “I’m not saying it’s right, but that at least makes some sense. It wasn’t a senseless thing.”
Montoya Gonzalez was given a $70,000 bond, court records show; it is unclear if he has been released.
