Kendra Duggar and Husband Joseph Receive 1-Year Advisement Period in Child Neglect Case After Changing Pleas

Kendra Duggar and her husband, Joseph Duggar, have been given a potential path toward having their Arkansas child neglect charges dismissed after withdrawing their not guilty pleas.

The couple appeared in an Arkansas court on Aug. 10, where they entered pleas by order in the case stemming from allegations involving their four young children.

 

Kendra, 28, and Joseph, 31, were each charged with four counts of second-degree endangering the welfare of a minor and four counts of second-degree false imprisonment following a March search of their home.

Rather than proceeding immediately toward trial, the couple have now been placed on a 12-month “advisement period,” according to court documents obtained by PEOPLE.

The period began with their Aug. 10 court appearance and is scheduled to run through Aug. 4, 2027.

Under the terms of the court’s diversion order, the charges will be dismissed if Kendra and Joseph successfully complete the year without committing any new criminal offenses and while maintaining good behavior.

They are also required to pay $1,850 and comply with all court orders during the advisement period.

If they satisfy those conditions, prosecutors will dismiss all of the charges against them.

 

The precise circumstances that led to the Arkansas case remain largely unclear. Neither Kendra nor Joseph has publicly discussed the allegations, and their attorney, Travis Story, has also declined to comment.

The charges were filed after the Tontitown Police Department and the Arkansas Department of Human Services conducted a joint search of the couple’s home on March 19.

At the time, Kendra and Joseph were living at the residence with their four children.

The search occurred just one day after Joseph was arrested in Arkansas on a warrant from Florida.

That separate case involves allegations that Joseph committed lewd and lascivious molestation against a victim under 12 and lewd and lascivious behavior by an adult. Those charges were filed in Bay County, Florida, and are unrelated to the Arkansas case involving Kendra.

Joseph was already being held in Arkansas while awaiting extradition to Florida when the child welfare charges were filed.

Kendra was subsequently taken into custody and booked into the same jail. She was released several hours later after posting bail.

According to previous reports, Kendra was then taken to an undisclosed location by her mother-in-law, Michelle Duggar.

Following Kendra’s arrest, she was temporarily prohibited from having contact with her children for approximately a month.

Joseph remains subject to restrictions involving his children in the separate Florida case. As a condition of his pretrial release, he is not permitted to have unsupervised contact with his four children.

 

The Florida allegations against Joseph are particularly significant because they involve a separate investigation and could carry serious consequences if he is convicted. He has been accused in connection with an alleged incident involving a 9-year-old girl in 2020, although the allegations remain unproven in court.

For now, however, the Arkansas case has taken a different turn.

Rather than facing an immediate trial on the eight charges filed against them, Kendra and Joseph have been given a year to comply with the court’s conditions.

If they remain law-abiding, maintain good behavior, pay the required fine and follow the court’s orders through the end of the advisement period, the charges against both of them are expected to be dismissed.

Their next year could therefore prove crucial, as the couple attempt to put the Arkansas case behind them while Joseph continues to face the unrelated criminal proceedings in Florida.
