The former Colleton County court clerk whose actions contributed to the overturning of Alex Murdaugh’s murder conviction is now asking a federal judge to dismiss a major lawsuit filed against her by the disgraced attorney.
Becky Hill, who served as clerk during Murdaugh’s highly publicized 2023 double-murder trial, has been accused of improper conduct involving jurors—allegations that ultimately helped lead the South Carolina Supreme Court to vacate his convictions. That ruling granted Murdaugh a new trial after the court found he was deprived of a fair legal process due to Hill’s behavior.
Now, Hill is pushing back against Murdaugh’s civil lawsuit seeking $600,000 in damages, arguing she should be protected from liability. In court filings, her legal team claims she is entitled to immunity because she was acting in her official capacity as a court clerk at the time of the alleged misconduct.
Her attorneys also argue that Murdaugh’s financial losses are not directly tied to her actions. They say he would have incurred the same legal fees regardless of any alleged interaction with jurors, since the murder charges and trial process were initiated by prosecutors and law enforcement—not the clerk herself.
The motion further asserts that Murdaugh’s lawsuit relies on a legal theory that has not been recognized in the Fourth Circuit, and that the proper remedy for any trial issues was already provided when he was granted a new trial.
Hill’s legal team also points to earlier judicial findings that were more divided on whether her conduct rose to the level of a constitutional violation, arguing this shows the case is not as clear-cut as Murdaugh suggests.
The filing comes after Hill previously pleaded guilty to obstruction, perjury, and misconduct charges related to her handling of the trial. She later resigned from her position, but continues to face legal and financial fallout tied to the overturned conviction.
As the civil case moves forward, both sides remain locked in a bitter dispute over responsibility, immunity, and whether Murdaugh is entitled to additional compensation beyond his overturned conviction.
